Acceptance of Terms

By accessing or using SellSmartCT ("the Site," "the Service," "we," "us"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use this site.

These Terms constitute a legally binding agreement between you and the operator of SellSmartCT. "You" means any person who accesses or uses the Service.

Description of Service

SellSmartCT provides a free home positioning report tool designed to help Connecticut homeowners understand how their property may compete in the current real estate market before listing. The Service includes:

• An AI-powered instant positioning preview based on property details you submit
• A follow-up positioning report prepared and delivered by a licensed real estate agent
• An optional paid strategy call ($49) with the operating agent
• Educational content about real estate positioning concepts including demand analysis, PACE risk profiling, and market positioning

The Service is provided free of charge except for the optional $49 strategy call. Use of the Service does not obligate you to list your property with any agent.

Not a Redfin Product

SellSmartCT is an independent tool created and operated by Jimmy Edwards in his personal capacity as a licensed real estate professional. This Site is not:

• A product of Redfin Corporation
• Affiliated with, sponsored by, or endorsed by Redfin Corporation
• Subject to Redfin's terms of service or privacy policies

Jimmy Edwards is a licensed Associate Broker who works with Redfin. His use of this independent tool does not represent Redfin's views, policies, or services. Any real estate transactions may be subject to Redfin's brokerage agreements separately.

Not Legal or Financial Advice

You should consult with licensed professionals including real estate attorneys, certified appraisers, and financial advisors before making decisions about selling your property. The information provided through this Service is for informational purposes only.

AI-Generated Content Disclaimer

The instant positioning preview generated by this tool uses artificial intelligence (Anthropic's Claude API) to analyze the property details you provide. You understand and agree that:

• AI-generated content is based solely on the information you provide and general market knowledge — it does not access live MLS data, property records, or current comparable sales
• The AI preview is a preliminary snapshot, not a formal market analysis or appraisal
• AI-generated outputs may contain errors, omissions, or inaccuracies
• The full positioning report delivered by a licensed agent will incorporate live MLS data and should supersede the AI preview for decision-making purposes
• You should not make material financial decisions based solely on the AI-generated preview

We make no warranties regarding the accuracy, completeness, or fitness for any particular purpose of AI-generated content.

User Representations

By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal right to provide information about the property you describe (i.e., you are the owner, authorized representative, or acting with the owner's permission)
• The information you provide is accurate to the best of your knowledge
• You will not use the Service for any unlawful purpose
• You will not attempt to reverse-engineer, scrape, or misuse the Service
• You are a Connecticut or New York resident or are inquiring about a property located in those states

No Agency Relationship Created

Submitting your information through this Service does not create a buyer-agent or seller-agent relationship, a brokerage agreement, or any other professional relationship. A formal agency relationship with a licensed real estate broker requires a signed representation agreement in accordance with Connecticut and New York real estate law.

You are under no obligation to hire any agent as a result of using this Service.

Intellectual Property

All content on this Site — including text, design, graphics, logos, and the positioning framework (Demand Circle, Buyer Funnel, PACE Diagnosis) — is the intellectual property of SellSmartCT and its operator. You may not reproduce, distribute, or create derivative works without written permission.

The SellSmartCT name and brand are independently owned and not affiliated with any other entity of the same or similar name.

Limitation of Liability

To the fullest extent permitted by applicable law, SellSmartCT and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or reliance on the Service or any content provided
• Errors or inaccuracies in AI-generated positioning previews
• Delays or failure in delivering the positioning report
• Any real estate transaction decisions made based on information from this Service
• Unauthorized access to or alteration of your submissions

In no event shall our total liability to you exceed the amount you paid to use the Service (if any), or $100, whichever is greater.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied.

Indemnification

You agree to indemnify, defend, and hold harmless SellSmartCT and its operator from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Third-Party Services

This Service integrates with third-party platforms including Netlify (hosting and forms), Anthropic (AI processing), and Calendly (scheduling). Your use of those services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

The $49 Strategy Call

The optional $49 strategy call is a one-time, flat-rate working session with the operating agent. The following terms apply:

• Payment is collected separately at the time of booking via Calendly
• The $49 fee will be credited toward the agent's commission if you list your home with Jimmy Edwards within 12 months of the call date
• The call is a consulting session, not a listing agreement or brokerage commitment
• Refunds may be issued at the operator's discretion if the call is cancelled with at least 24 hours notice
• No refund is provided for no-shows or cancellations with less than 24 hours notice

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut.

Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
